Privacy Policy

Black Forest Holdings LLC ("we," "us"), 2108 N ST STE N, Sacramento, CA 95816, operates the MarketLoan website at marketloan.blackforestholding.com (the "Site"). This policy explains what we collect on the Site, why, and your choices. It covers this informational website only; the future MarketLoan lending marketplace will have its own, more detailed privacy policy.

1. What we collect

• Information you give us.When you join the waitlist we collect your email and the side of the marketplace you're interested in. When you request a call we collect your name, email, and any company or message you provide. If you book a call, that is handled by Google's scheduling tool under Google's terms.
• Usage & device data. Pages viewed, referrers, approximate location (derived from IP), browser and device type, and on-page interactions, collected automatically via analytics. This includes session replay — a reconstruction of on-page interactions used to understand and improve the Site — with the contents of input fields masked.
• Cookies & similar technologies. Analytics identifiers and preference cookies (see §5).

We do not collect financial account numbers, government IDs, or payment information through the Site, and we do not knowingly collect information from children under 16 (see §8).

2. How we use it

• Respond to inquiries and requests you send us.
• Send product updates to people who join the waitlist.
• Understand Site usage and improve the product (analytics).
• Security, abuse prevention, and legal compliance.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

3. Who we share it with

Service providers acting for us under contract: PostHog (analytics, session replay, and surveys), Supabase (database), Upstash (rate limiting), Vercel (hosting), Google (Google Analytics, and Google Calendar for scheduling), and professional advisors where required. We may disclose information to comply with law, enforce rights, or in a corporate transaction (including the planned formation of a successor operating company, in which case this policy or a successor continues to apply).

4. Retention

We keep contact and waitlist information until it is no longer needed for the purposes above or you ask us to delete it. Analytics data is retained per our analytics provider's configured retention period. We delete or de-identify data when it is no longer needed.

5. Cookies and analytics choices

The Site uses PostHog and Google Analytics. You can opt out of analytics and session recording using the cookie notice shown on your first visit (choose "Decline"), and we honor Global Privacy Control (GPC) and Do-Not-Track browser signals for applicable data. You can also block or delete cookies in your browser settings.

6. Your rights

California residents (CCPA/CPRA): rights to know, delete, correct, and opt out of the sale or sharing of personal information (we do not sell or share), and to non-discrimination for exercising these rights. EEA/UK visitors (GDPR): rights to access, rectify, erase, restrict, port, and object; our legal bases are legitimate interests (analytics, security) and consent where required. 7. Security

We use reasonable administrative and technical safeguards, including access controls, TLS, and vendor diligence. No method is 100% secure, and we cannot guarantee absolute security.

8. Children

The Site is not directed to children under 16, and we delete any such information on discovery.

9. Changes

We will post changes here with a new effective date; material changes will get a prominent notice.
